    Privacy Policy

    These policies apply to FunnelStreams.com, FunnelStreams.ai, related subdomains, applications, account areas, training, communities, and services that link to them.

    This Privacy Policy explains how MediaCraft Marketing, LLC d/b/a FunnelStreams ("FunnelStreams," "we," "us," or "our"), collects, uses, discloses, and protects personal information.

    It applies to FunnelStreams.com, FunnelStreams.ai, related subdomains, applications, account areas, training, communities, support, events, and other services that link to this Policy (collectively, the "Services").

    1. Information covered by this Policy

    "Personal information" means information that identifies, relates to, describes, or could reasonably be linked with a person or household. The exact definition may vary by law.

    This Policy covers personal information that FunnelStreams handles for its own business purposes, including information about:

    • Website visitors
    • Prospective and current customers
    • Account owners, administrators, and authorized users
    • Event and community participants
    • Affiliates, partners, and vendors
    • People who contact us or interact with our marketing

    Customer-controlled data

    Our customers may use the platform to collect and manage information about their own leads, customers, members, employees, or other people.

    For that information, the customer generally decides why and how it is processed. FunnelStreams generally acts as a service provider or processor on the customer's behalf.

    If your information was submitted to the Services by a FunnelStreams customer, contact that customer first to exercise your privacy rights. We may refer your request to the customer.

    This Policy does not replace a customer's own privacy notice.

    2. Personal information we collect

    Depending on how you use the Services, we may collect the following categories.

    Contact and identity information

    Name, business name, job title, username, account ID, email address, phone number, mailing address, social-media profile, and similar identifiers.

    Account and profile information

    Login information, account settings, plan, user role, permissions, preferences, profile details, and authentication records.

    Payment and transaction information

    Billing address, subscription details, purchases, invoices, payment status, transaction identifiers, refunds, and chargebacks. Payment-card information is generally collected and processed by our payment providers rather than stored directly by FunnelStreams.

    Customer Content

    Content you upload, import, create, store, or transmit through the Services, including contacts, messages, forms, websites, funnels, courses, community posts, files, recordings, prompts, and AI inputs or outputs.

    Communications

    Messages and attachments you send to us, support requests, survey responses, call or meeting details, and records of your communications preferences. We may record calls or meetings when notice or consent is provided as required.

    Audio, visual, and likeness information

    Photos, video, audio, voice recordings, or other media that you choose to upload or create. If you request an AI feature that uses a face, voice, or likeness, we may process characteristics contained in that media to provide the requested feature. Additional notice and consent may apply.

    Device, log, and usage information

    IP address, browser type, device type, operating system, app version, pages viewed, links clicked, referring page, dates and times, session details, feature use, error logs, diagnostic data, and approximate location inferred from an IP address.

    Cookie and advertising information

    Cookie identifiers, analytics events, advertising identifiers, campaign attribution, and information about interactions with our sites and ads. See the Cookie Policy.

    Integration information

    Information received from services you connect, such as calendars, email providers, social platforms, payment services, file-storage services, or other integrations. The information depends on your settings and permissions with the connected service.

    Information from public and third-party sources

    Business contact information, public profiles, referral information, fraud and security signals, marketing information, and information from partners or service providers.

    3. How we collect information

    We collect personal information:

    • Directly from you
    • Through your use of the Services
    • From an account owner, administrator, customer, or referral partner
    • From services you connect
    • From payment, hosting, analytics, advertising, communications, security, and other providers
    • From public sources

    4. How we use personal information

    We may use personal information to:

    • Provide, operate, maintain, and secure the Services
    • Create and administer accounts
    • Process purchases, subscriptions, payments, and refunds
    • Deliver software, training, support, communities, and events
    • Configure features and integrations
    • Process Customer Content under a customer's instructions
    • Communicate about accounts, transactions, security, support, and service changes
    • Send marketing where permitted and manage communication preferences
    • Personalize content and measure site, product, and campaign performance
    • Improve features, usability, reliability, and customer support
    • Develop new products and services using aggregated, de-identified, or otherwise lawfully processed information
    • Detect, prevent, and investigate fraud, spam, abuse, security incidents, and policy violations
    • Enforce agreements and protect rights, safety, and property
    • Comply with legal, tax, accounting, regulatory, and law-enforcement requirements
    • Complete a merger, financing, acquisition, sale, reorganization, bankruptcy, or similar business transaction

    Where a law requires a legal basis, we process personal information based on one or more of the following:

    • Performance of a contract
    • Your consent
    • Our legitimate interests, such as providing, improving, securing, and marketing the Services
    • Compliance with a legal obligation

    5. How we disclose personal information

    We may disclose personal information to:

    Service providers and processors

    Companies that help us provide hosting, storage, payments, billing, email, SMS, voice, AI features, analytics, advertising, customer support, security, fraud prevention, communications, and other business operations.

    They may process information only for the services they provide to us, subject to applicable contractual and legal restrictions.

    Integrations and third-party services

    When you connect or direct us to use a third-party service, we disclose information as needed to complete your request. Your use of that service is also governed by its terms and privacy policy.

    Customers and account administrators

    An account owner or administrator may access and control information associated with users, contacts, sub-accounts, and activity under that account.

    Affiliates and business partners

    We may disclose information to corporate affiliates or partners that help provide or promote a requested product, event, or service.

    Advertising and analytics partners

    We may allow analytics and advertising partners to collect device, cookie, and activity information from our sites. Some laws may define this as a "sale," "sharing," or targeted advertising even when no money changes hands.

    Legal, safety, and compliance recipients

    We may disclose information when we reasonably believe it is necessary to comply with law, respond to lawful process, enforce our agreements, collect amounts owed, investigate abuse, or protect the rights, safety, and property of FunnelStreams, our customers, or others.

    Business transaction recipients

    Information may be disclosed or transferred in connection with a financing, merger, acquisition, reorganization, bankruptcy, sale of assets, or similar transaction.

    With your direction or consent

    We may disclose information when you direct us to or give consent.

    6. Sale, sharing, and targeted advertising

    We do not sell personal information for money.

    Our use of some advertising and analytics technologies may be considered a "sale" or "sharing" of personal information, or targeted advertising, under certain state privacy laws.

    Where applicable, you may opt out through the "Your Privacy Choices" or "Do Not Sell or Share My Personal Information" link on our sites. We will also process a recognized Global Privacy Control signal as an opt-out request for the browser or device where the signal is enabled when required by law.

    We do not knowingly sell or share the personal information of people under 16.

    7. Cookies and similar technologies

    We use cookies, pixels, local storage, and similar technologies for site operation, account access, preferences, analytics, security, marketing, and advertising.

    You can manage nonessential technologies through the cookie settings available on our sites where provided. See our Cookie Policy for more information.

    8. Marketing choices

    You may unsubscribe from marketing email using the link in the message.

    You may opt out of marketing text messages by replying STOP or using another reasonable method described in the message. Message and data rates may apply.

    We may still send non-marketing communications about your account, purchases, security, support requests, or changes to the Services.

    9. Data retention

    We retain personal information only as long as reasonably necessary for the purposes described in this Policy, including to provide the Services, maintain business and financial records, comply with law, resolve disputes, prevent fraud, enforce agreements, and protect security.

    Retention depends on the type of information, the account status, legal requirements, the sensitivity of the information, and technical needs.

    Customer Content may be deleted after account termination as described in the Terms of Service and applicable order form. Information may remain in backups until those backups expire through our normal cycle.

    We may retain aggregated or de-identified information that can no longer reasonably identify a person.

    10. Security

    We use reasonable administrative, technical, and physical safeguards designed to protect personal information.

    No system or transmission method is completely secure. You are responsible for protecting your credentials, using available security features, limiting user access, and securing devices and connected services.

    11. International processing

    FunnelStreams and its providers may process personal information in the United States and other countries. Those countries may have privacy laws different from the laws where you live.

    Where required, we use lawful safeguards for cross-border transfers.

    12. Your privacy rights

    Depending on where you live and subject to legal exceptions, you may have the right to:

    • Know whether we process your personal information
    • Access personal information
    • Correct inaccurate personal information
    • Delete personal information
    • Receive a portable copy of certain information
    • Opt out of sale, sharing, or targeted advertising
    • Limit certain uses of sensitive personal information
    • Withdraw consent where processing is based on consent
    • Appeal a denied privacy request
    • Receive equal service and not be discriminated against for exercising a privacy right

    To submit a request, email Support@FunnelStreams.com with the subject line "Privacy Request."

    Describe the right you want to exercise and provide enough information for us to locate the relevant records. We may need to verify your identity and authority. An authorized agent may submit a request where permitted, but we may require proof of authorization and direct verification with the person.

    If the information is controlled by a FunnelStreams customer, submit the request to that customer.

    You may appeal a denied request by replying to our decision with "Privacy Appeal" in the subject line.

    13. Additional notice for California residents

    This section applies where the California Consumer Privacy Act, as amended, applies to our processing.

    We collect these categories from the sources described in Section 3 and use them for the purposes described in Section 4.

    We may disclose each category for a business purpose to the recipients described above.

    We do not sell personal information for money. We may share identifiers and internet or network activity with analytics or advertising partners in a way California law defines as "sharing" for cross-context behavioral advertising.

    We do not use or disclose sensitive personal information to infer characteristics in a manner that creates a right to limit unless our practices change and the law requires us to provide that right.

    California residents may exercise the rights described in Section 12, including the rights to know, access, correct, delete, and opt out of sale or sharing. See Section 6 for opt-out methods.

    We do not discriminate against a person for exercising a California privacy right.

    14. Other U.S. state privacy rights

    Residents of states with applicable consumer privacy laws may have rights similar to those listed in Section 12, including rights to opt out of targeted advertising, sale, or certain profiling.

    Submit a request or appeal using the methods in Section 12. We will respond according to the law that applies.

    15. Children

    The Services are intended for adults and business users. They are not directed to children under 18, and we do not knowingly collect personal information directly from children under 13.

    If you believe a child has provided personal information to us without appropriate permission, contact Support@FunnelStreams.com.

    Customers who use the Services to interact with minors are responsible for complying with applicable law and obtaining required parental or guardian consent.

    The Services may link to third-party websites or services. Their privacy practices are governed by their own policies. We are not responsible for third-party privacy practices.

    17. Changes to this Policy

    We may update this Policy to reflect changes to our Services, business practices, providers, or legal obligations.

    We will post the revised Policy and update the effective date. If required, we will provide additional notice or obtain consent.
